Commentary

The City Council may consider the closing of street right-of-way upon petition by one or more adjoining property owners.

The Council  shall consider future street needs and location of existing utilities before proceeding with a Resolution of Intent to Close.

Upon passage of a Resolution of Intent to Close, all adjoining property owners will be served with a notice of public hearing and copy of the Resolution of Intent to Close.

The Resolution of Intent to Close shall also be published once a week for four weeks in the Sanford Herald.

After the public hearing is held and the City Council  is satisfied the closing of the street is not contrary to the public interest and that property owners in the vicinity of the street will not be deprived of reasonable means of ingress and egress to their property, then the Council may adopt a resolution ordering the closing of the street.

Title to the street right-of-way shall be divided among the adjoining property owners.
