STREET CLOSING PROCEDURE |
| A. Filing a Request |
|
1. For more information contact the Planning Division at 718-4656. 2. Prior to being submitted, petitioner should contact all individual property owners abutting street right-of-way proposed for closing. 3. Filing Fee: All cost associated with the street closing will be charged to the petitioner. |
| B. Stages of Approval |
|
The
City Council may consider the closing of street right-of-way upon petition
by one or more adjoining property owners.
The
Council shall consider
future street needs and location of existing utilities before proceeding
with Upon
passage of a Resolution of Intent to Close, all adjoining property owners
will be served with
a notice of public hearing and copy of the Resolution of Intent to Close.
The
Resolution of Intent to Close shall also be published once a week for
four weeks in the Sanford Herald.
After
the public hearing is held and the City Council is
satisfied the closing of the street is not contrary to the public interest
and that property owners in the vicinity of the street will not be deprived
of reasonable means of ingress and egress to their property, then the
Council may adopt a resolution ordering the closing of the street.
Title to the street right-of-way shall be divided among the adjoining property owners. |

4 - Public Hearing Following Four Weeks of Advertising
5- Resolution Ordering Street Closed
6 - Recordation at Lee County Register of Deeds of Resolution Ordering Street Closed, Publisher's Affidavit, and Notarized Copy of Letters Mailed to Abutting Property Owners
